Introduction

These Terms and Conditions ("Terms") govern your access to and use of the Away website, mobile applications, and related services operated by Go Waya Tech Private Limited ("Away", "we", "us", or "our"). By using our Platform, you agree to be bound by these Terms.

If you do not agree with these Terms, you must not access or use the Platform. Please also review our Privacy Policy.

Eligibility and Acceptance

  • You must be at least 18 years old and legally capable of entering into binding contracts.

  • If you use the Platform on behalf of another person or entity, you confirm that you are authorised to accept these Terms on their behalf.

  • You are responsible for ensuring that all information provided during booking is accurate and complete.

Accounts and Security

You may need to create an account to access some features. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You must promptly notify us of any unauthorised use of your account. We may suspend access where we reasonably suspect fraud, misuse, or security risks.

Bookings and Contract Formation

  • Search and Availability: Search results, fares, room rates, and inventory are subject to availability and may change until booking is confirmed.

  • Confirmation: A booking is confirmed only when you receive a valid confirmation reference or ticket or booking voucher from us or the supplier.

  • Supplier Terms: Flights, hotels, activities, insurance, and other travel products are subject to separate terms imposed by relevant suppliers.

  • Traveller Details: You must verify traveller names, dates, passport details, and contact information before final payment.

Product-Specific Terms

Flights

Fare rules, baggage, schedule changes, check-in cut-offs, and no-show penalties are controlled by the operating airline. Partially used tickets may have different refund rules.

Hotels and Stays

Hotel confirmation, meal plans, check-in and check-out, city taxes, and no-show charges are governed by the property terms. Early departure or partial stay usage may not be refundable.

Activities and Transfers

Tours, activities, and transfers may require reporting at specific times and meeting points. Missed slots or late arrival may be treated as no-show.

Travel Insurance

Policy issuance, claim acceptance, exclusions, and payout timelines are determined by the insurer under policy wording.

Pricing, Taxes, and Payment

  • Displayed Pricing: Prices generally include base fare or base rate and applicable taxes unless otherwise specified. Convenience fees, service fees, and supplier fees may apply.

  • India Tax and Compliance: GST, TCS, TDS, and other statutory levies may apply depending on itinerary, booking type, and prevailing law. You are responsible for furnishing accurate tax details where required.

  • TCS for International Travel: Tax Collected at Source (TCS) may be applicable on international travel bookings and related remittances under prevailing Indian tax law. Where applicable, TCS will be collected and reflected in your invoice or tax documents.

  • Cross-Border Bookings: Some bookings may involve overseas suppliers and may be charged in a different currency. Final charged amount can vary due to exchange rates, bank markups, or payment network rules.

  • Payment Authorisation: By providing payment details, you authorise us and our payment partners to charge the total amount payable for the booking.

Fraud Screening and Verification

We may perform automated and manual fraud checks before or after payment. We may request additional identity, card ownership, or traveller verification documents to validate a booking.

If we reasonably suspect fraud, misuse, or unauthorised payment, we may hold, cancel, or decline the booking and may report the activity to payment networks, banks, or law enforcement.

Cancellations, No-Shows, and Refunds

  • Cancellation and Change Rules: Cancellation, rescheduling, and amendment rules vary by airline, hotel, insurer, and other suppliers. Supplier penalties and fees may be deducted before refund.

  • No-Show and Partial Usage: No-show bookings are often non-refundable. Partially used tickets, split itineraries, and partially consumed hotel stays may attract reduced or zero refund.

  • Refund Timelines: Where approved, refunds are initiated to the original payment source. Typical timelines can range from 7 to 45 business days depending on supplier settlement cycles, card networks, UPI or bank rails, and intermediary systems.

  • Service Fees: Away service fees, convenience fees, and payment gateway charges may be non-refundable unless explicitly stated otherwise.

Chargebacks and Payment Disputes

If you raise a payment dispute or chargeback, we may temporarily suspend related bookings or account features while the dispute is under review.

You agree to cooperate and provide requested documents. Fraudulent or abusive chargebacks may result in booking cancellation, limitation of payment options, and account suspension.

Traveller Responsibilities

  • You are solely responsible for valid passports, visas, permits, vaccinations, travel insurance, and any other entry or exit requirements.

  • You must comply with all airline, hotel, transport operator, and local authority rules.

  • You are responsible for arriving on time for check-in, boarding, and supplier deadlines.

  • We are not responsible for denied boarding, denied entry, missed connections, or losses caused by incomplete or inaccurate documentation.

Third-Party Suppliers

Away acts as an intermediary for many travel products and does not control third-party suppliers. Supplier actions, service quality, schedule changes, overbookings, and operational decisions are outside our direct control.

We will make commercially reasonable efforts to assist you in coordinating with suppliers where issues arise, but final decisions may rest with the supplier.

Force Majeure

We will not be liable for delay, interruption, non-performance, or cancellation caused by events beyond reasonable control, including natural disasters, pandemics, war, terrorism, civil unrest, government actions, airspace restrictions, transport disruption, strikes, or system-wide outages.

In such events, supplier rules will generally govern refunds, credits, rebooking, or waivers.

Prohibited Use

  • Use of the Platform for unlawful, fraudulent, abusive, or misleading activity.

  • Creating speculative, false, or duplicate bookings.

  • Using bots, crawlers, spiders, scripts, or any automated/manual means to scrape, extract, copy, mirror, republish, or index Platform content, pricing, inventory, or user data without prior written permission.

  • Interfering with Platform security, bypassing access controls, reverse engineering, or attempting unauthorised access.

  • Reselling travel services obtained on the Platform without prior written permission.

Intellectual Property

All Platform content, including logos, text, graphics, software, design, and trademarks, is owned by or licensed to Away and protected by applicable intellectual property laws.

You may use the Platform only for personal, non-commercial travel planning and booking purposes unless expressly authorised by us in writing.

Disclaimers

The Platform and services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the fullest extent permitted by law, Away will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of data, profits, goodwill, or opportunity.

Our aggregate liability arising out of or in connection with your use of the Platform or any booking will not exceed the service fees actually paid by you to Away for the relevant transaction.

Indemnity

You agree to indemnify and hold harmless Away, its directors, officers, employees, and affiliates from claims, liabilities, losses, damages, and expenses arising out of your breach of these Terms, violation of law, or misuse of the Platform.

Suspension and Termination

We may suspend or terminate your access to the Platform, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent conduct, or created legal or security risk.

Grievance Redressal

For complaints and escalation under applicable Indian consumer and information technology laws, you may contact our Grievance Officer using the details below. Please include booking reference and issue summary for faster resolution.

Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Courts at Bengaluru, Karnataka, India shall have exclusive jurisdiction, subject to any mandatory consumer rights available under applicable law.
